What is the collection process in Tajikistan?
The process of debt recovery usually starts with sending a letter of claim to the debtor. If the latter does not pay the required amount within one month or the parties do not enter into settlement agreement, we draft a statement of claim and file it along with other documents (the claimant charter, contract, letter of claim, invoices, PoA for representatives etc.) to the court. Documents issued abroad must have apostille and a certified translation into the state (Tajik) language. After considering the case, the court makes a decision to satisfy the claim fully or in part or to reject the claim. In case if the debtor does not appeal the court decision we initiate enforcement proceeding. If we do not agree with the court decision, we may appeal it within one month to cassation court instance.
