What is the debt collection process in Tonga?
Collection process is usually done by bailiff officers, under the ministry of Justice who are empowered thru writ of distress to carry out seizing of properties to be sold by public or private auction. There is no time limitation to collect debt. However, it depends on nature of the property to be seized.
Can late payment fees / interest to be added to claims?
Interest is allowed for in civil claims and for late payments, interest attracts as penalty.

Our legal process is similar to any Courts of the Commonwealth. Once you filed a writ of summon attaching a statement of claim, you serve them and the defendants have 28 days to reply, If no reply, you go for judgment. If reply given, you go for disclosure of documents, exchange of documents, preparing briefs of evidence, fixing of hearing dates and the actual trial. The minimum time you will have a hearing after filing a civil summon is at least 9 months. We have three high court judges who are sitting in our Supreme Court. One of them presides over criminal matters, one deals with land matters, family and divorce and the Chief Justice deals with civil and anything else.
These three judges also do circuits to the outer islands twice within a year. So it takes at least 9 months before you have a hearing.
